General Terms

This document containing the terms and conditions of use of the site www.contconsulting.ro (named as “Terms and Conditions”) sets out the conditions under which any person may visit or access the site www.contconsulting.ro, or may use in any way the services offered through the Site.

In the interest of the Terms and Conditions: “Site” means the website www.contconsulting.ro; “Service” means any service offered on the Site, and / or any module or component of it; “User” means any person who visits or accesses the Site, who creates an account on the Site or wishes to use it in any way or actually uses the Service.

Not accepting these Terms and Conditions or any provision of it, as formulated in this act, involves the obligation of the User to immediately cease accessing the Site; accessing or further visiting the Site, any page thereof and / or using the Service, as well as any component thereof constitutes full and unconditional acceptance of the Terms and Conditions.

By registering, the User fully and unconditionally accepts the provisions of these Terms and Conditions and understands to use the Service in strict accordance with them. Rights over the content of the Site

The content and graphics of the Site, as well as all content in text format and any other material, transmitted in any form by and to Users (by direct viewing on the Site, by newsletters or by any other materials directly or indirectly related to the Site) belong to the Site Administrator and its partners and represent the content of the Site.
By way of derogation from the previous provision, the Site Administrator or its partners do not belong to those materials for which it eas indicated another holder of rights, another owner or another source, nor the opinions and / or comments of any Users of the Site posted on the Site or to the Content of the Site in general.

The answer received as a result of completing the mini-consultation form does not have the value of a real consultation and the Site Administrator cannot be responsible for this informal answer, as it has a purely informative purpose and does not constitute an adequate medical treatment.

Users are required to respect all copyrights and related rights and any other intellectual property rights that the Site Administrator and its partners hold over / in connection with the Site, its Content, the Service, any module or component of it or in connection with their use. Users understand and accept that in case of violation of any of the above provisions in any measure, they may be held liable to the authors / owners of the Site Content.

The Content of the Site, regardless of the area in which it is located on the Site and regardless of type, may be used exclusively for personal purposes, defined in accordance with this document as purely non-commercial purposes, without any direct or indirect intention to obtain profits or gains of any kind from such use. Any use of content by third parties for any purpose other than personal purposes may be done only with the written, prior consent of the Site Administrator.

It is prohibited to copy, retrieve, reproduce, publish, transmit, sell, distribute all or part of the content of this Site or any part thereof for any purpose other than personal ones; The Site Administrator reserves the right to take legal action against any person and/or entity that in any way violates the above provisions. Any person who in any way transmits information or materials to the Site undertakes an obligation to not prejudice the copyright that a third party may invoke in connection with the materials and information transmitted in any way to the Site, and persons who in any way send information or materials understand and accept that the violation in any way of this obligation may not in any way commit the liability of the Site Administrator , but only the responsibility of those persons.

Users who in any way send information or materials to the Site agree to assign exclusively, indefinitely and in all territories, at the time of their submission to the Site Administrator, all rights of use, adaptation, modification and/or retransmission of the content with which they contribute or post on the Site. The Site Administrator cannot be held responsible for any damage caused by content posted or uploaded to the Site or in any of its modules (such as the order or mini-consultation form) on the Site by any person, regardless of which section, service or facility that content belongs to.

Any person who in any way sends information, comments, opinions, or materials to the Site undertakes an obligation not to harm other Users in any way through the information, comments and matters sent, and accepts and understands that they are the only ones who can be held responsible for their veracity, validity, accuracy of information, comments, opinions and materials, including but not limited to legal consequences in relation to their use.

It is strictly forbidden to post on the Site any content, including material, comments, images, video sequences which have obscene or vulgar language, contain illegal, threatening, abusive, indecent texts, racist or likely to discriminate against any person in any way, or that would violate any other human rights and freedoms under applicable law.

Users understand and accept that in case of violation in any way and to any extent of any of the provisions of the Terms and Conditions, the Site Administrator may choose discreetly to do not publish any content sent by the User for posting to the Site or to modify such content in any way, without any prior noticeors or notices and without any other formalities to do so.

Information note on personal data protection

According to the requirements of Law no. 677/2001 for the protection of persons regarding the processing of personal data and the free movement of these data, amended and supplemented, and of Law no. 506/2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector, the Site Administrator will administer in safe conditions and only for the specified purposes, the personal data provided by the Users. We inform you that the personal data that Users provide to the Site Administrator are processed in order to provide the Service in optimal conditions. By registering on the Site / filling in the programming / mini-consultation form or any other way of taking over such personal data, the User declares that he agrees that all personal data be included in the database of the Site Administrator and gives his consent expressly and unequivocally that all personal data be stored and used for:

marketing activities by receiving informational or commercial messages at the e-mail addresses communicated
participation in competitions, promotions
transmission of non-commercial or administrative messages (on site changes, administration, etc.)
internal statistics necessary to improve the quality of the services offered and the image of the Site
to ensure access to restricted sections of the Site
market research
tracking sales data

At the same time, the User has the right to object to the processing of personal data concerning him and to request the deletion of the data.

The Administrator of the Site is the controller of personal data entered in the register of personal data processing under no. 18170.

The connection with other websites

Users understand and accept that the Site may contain links to other Internet sites, including personal sites (blogs), sites of suppliers of products and / or services to which they send advertising banners posted on the Site or microsites advertising, but not limited to, which are considered by the Site Administrator useful in connection with the Content of the Site, but which is not under its control or guidance.

The Site Administrator is absolved of any responsibility for the content or opinions expressed on all the above mentioned websites, as well as their correctness and accuracy, and the Users understand and accept that these websites are not monitored, controlled or verified in any way by the Site Administrator. The inclusion of a link or reference to other Internet sites does not imply their approval in any way by the Site Administrator. When the Users access these internet sites, they do so at their own risk, knowing that the use of the services offered by these sites is subject to the conditions established by the administrators of these sites.

Limitation of liability

The Site Administrator does not assume the obligation and does not guarantee implicitly or expressly for the content of any kind of the Site, or for the entire content offered by the Users. The Site Administrator will make all reasonable efforts to ensure the accuracy and reliability of the Site and will endeavor to correct errors and omissions as soon as possible.

The Site Administrator does not offer any warranties or liability for the Content of the Site and under no circumstances may he be held liable for any loss or damage that may result from the use of any party, sequence, mode of the Content on the Site or the impossibility of its use, regardless of its cause, or from misinterpretation of any provisions of the Site Content.

Users understand and accept that the operation of the Site may be affected by certain objective conditions, and that any services offered through the Site are offered in accordance with the “as they are” principle, “as available”, and Users use these services at their own risk. Accordingly, the Site Administrator may not be held responsible for any information and data in the Site Content, including but not only those relating to text, images, video sequences, avatars, blogs, or any other activity related to use, as well as any other legal effect deriving from them.

Users understand and accept that the Site Administrator is absolved of any liability in the event of any shutdown, interruption, difficulty, malfunctionory or error in the operation of the Site as well as in any situation in which it would not prove that any errors or problems of a technical nature mentioned above are due directly and exclusively to the serious fault of the Site Administrator.

Users expressly understand and accept that the Site Administrator is absolved of any liability for any direct, indirect damages, including loss of profit, commercial view or other intangible losses, resulting from the use of the Site Content in any way or any legal effects deriving from it.

Users understand and accept that the Site Administrator is absolved of any liability for advertising messages posted on the Site or through the Service, as well as for goods or services provided by the authors of these advertising messages.

In cases of force majeure the Site Administrator and/or the operators, directors, employees, subunits, secondary offices and its representatives are totally exempt from liability. Force majeure cases include, but are not limited to, errors in the operation of the Site Administrator’s technical equipment, lack of internet connection functioning, lack of functioning of telephone connections, computer viruses, computer attacks of any kind and interference with malicious software, unauthorized access to the Site’s systems, operating errors, strike, etc.

Users agree to protect, insure and fully compensate the Site Administrator and/or its operators, directors, employees, subunits, secondary offices and representatives to and against any requests, claims, actions, charges, losses, damages, costs (including, without any limitation, the fees of lawyers, experts and consultants or executors, court, notarial or enforcement fees), expenses, judgments, decisions, fines, settlements or other obligations resulting from or related to any other action of the User in connection with the improper use of the Service/Site or any other aspect in connection with the Service/Site.

Applicable law. Litigation

The rights and obligations of the Users and the Site Administrator, as provided for in the Terms and Conditions, as well as all legal effects that the Terms and Conditions produce will be interpreted and governed in accordance with the Romanian law in force. Any dispute arising out of or in connection with the Terms and Conditions will be resolved amicably. In case of impossibility to reach an agreement, the dispute will be resolved by the competent Romanian court located within the territorial radius of the municipality of Bucharest.

Modification of the Terms and Conditions

The Site Administrator has the right to modify any of the provisions of the Terms and Conditions in full at any time and in any way, without any prior notice and without being required to perform any other formality with the Users. Any change will be considered to be fully and unconditionally accepted by any of the Users by simply using or accessing any facility offered by the Site or the Service, or by accessing the Site, occurring at any time after the change has been made. Failure to accept any change involves the obligation of the User to immediately cease accessing the Site and/or using the Service in any way.&
